To whom it may concern,

I'm not sure if I can explain this situation in fewer than one hundred words, but here I go. On June 04, 2008 I went to Schaumburg Kia in Schaumburg IL, and looked a used vehicle. I asked them if they wouldn't mind not running a credit check on me that day.

Everyone was in agreement, so they had me sign a spot delivery agreement which stated I had a five-day contingency. (I have the original of the spot delivery agreement).

Everything was done legally; they contacted a bank and gave me an interest rate, a monthly payment, monthly terms, and a final payout and I signed a retail installment agreement. The spot delivery agreement was to insure they had the five days in case anything popped up with my credit bureau. Is my credit the greatest? No, but it was good enough to obtain a loan on a vehicle.

To speed this situation up, Brian their finance manager stated, Mr. Sottile if you don't here from us in five days, everything is good so just look for your loan payment booklet by the end of June 2008.

The five days came and went, so I assumed as I was told everything was OK. Around the nineteenth of June 2008 I received a message that was at best scratchy and vague. It stated something is wrong with your loan. I contacted them via e-mail and stated what’s going on, the contingency was bypassed? I then mailed a copy of the original spot delivery agreement on June 20,2008 figuring maybe they had forgotten about the contingency.

Here is were it gets crazy, On June 24,2008 two gentlemen from Schaumburg Kia show up at my home and state you a loser, your a liar, and your credit ***. My mom was at the house and she is sixty -seven years old, so she came out and said what's going on here? They then called her old Mother Hubbard, and a fat ***. (Sorry for the language). My mother isn’t heavy.

To finalize this quickly, I have come to find out that they used my social security number with my birth name, and then they tried to loan me under an alias. They have destroyed my credit, so I can't purchase a vehicle to save my soul. I have hard copy evidence to prove this.

Schaumburg Kia then forged a spot delivery agreement with my signature, and entered it into a legal court proceeding which stated their was never any amount of days pertaining to a contingency, then there attorney from Debra Ashen's office in Chicago Il, stated in court that I indeed was given a five day contingency. Please note prior to court I sent Ms. Ashen at least fifteen faxes which stated your exhibit (B) is a forgery, I have every fax and fax transmission sheet I sent her.

Here is a question, then were did Schaumburg Kia's spot delivery agreement come from? In their pleading they stated I walked into their dealership stated I had a 700 credit rating, I was refinancing a home, and they were going to wait fifteen days prior to running a credit check on me. One thing, Brian their finance manager is also a mortgage broker, so wouldn't you think if their pleading is correct, he would've been smart enough to ask, Mr. Sottile can I see some refinancing papers or bank papers. You guessed it he never did.

One last thing, they didn't run a credit checks on me for over fifteen days, yet their attorney stated in a court of law that I was give a five day contingency.

I gave the vehicle back, why? Schaumburg Kia continually threatened to steal the vehicle, and it is much simpler to sue. I went to the KIA Corporation in Irvine California and talked to Marjorie Beards, and I told her no one wins here if I sue, can you become involved and help? Her response was sorry anti-trust laws.

What does anti-trust law have to do with consumer fraud and perjury? Please note this is not a lie, and I have factual evidence to prove every one of my claims. I would be more than happy to share them with anyone.

One last thing, the police were called on June 24,2008 when the two gentlemen came to my home trying to repossess the vehicle, the police told them, I'm sure you already know, you bypassed the contingency and your not touching his car.

The complaint is against Schaumburg Kia, not Daimler Chrysler. I apologize for this mistake, but I'm a first time user and I must have hit the wrong name.
